ARTICLE FOUR
Unit employees waiving City medical insurance coverage must provide
proof of enrollment in an authorized alternative non-City employer
sponsored or non-CalPERS employer sponsored group health plan and
waive any liability to the City related to the decision to decline coverage.

Dual Coverage
Dual medical coverage under City-sponsored health (CalPERS)
and/or ancillary plans is not permitted when both spouses and
registered domestic partners are City employees. An employee
may not be enrolled as both a subscriber and a dependent under
City-sponsored medical coverage.

Available Coverage Options
When both spouses and registered domestic partners are City
employees, they must elect one of the following options:
a. Both Employees Waive City Coverage
Each employee may waive City-sponsored medical coverage and
receive flex dollars, as described in Article Four (IV), provided each
employee submits proof of alternative, non-City sponsored or nonCalPERS-sponsored health coverage as a subscriber.
b. One Employee Enrolls Self and Other Employee as a Dependent
One employee may enroll in City-sponsored medical coverage as
the sole subscriber and may also enroll the other employee as a
dependent. If this occurs, only the employee enrolled as a
subscriber is eligible for flex dollars, if applicable.
c. Dependent Children who are also City Employees are Not
Eligible for Opt Out provisions unless proof of non-City sponsored
coverage is provided.

RE-ENROLLMENT IN CITY MEDICAL INSURANCE PLAN
Employees who previously opted out may re-enroll during open enrollment
or following an eligible qualifying event, as defined by PERS and the IRS
regulations pertaining to section 125 Cafeteria plans.
